Nahid Islam Moves SC Seeking Cancellation of BNP Candidate Kaiyum’s Nomination
Dhaka, Feb 8 : Nahid Islam, convenor of the National Citizen Party (NCP) and a candidate of the 11-party alliance, has filed an application with the Appellate Division challenging the dismissal of his writ that sought the cancellation of BNP-nominated candidate Dr MA Kaiyum’s nomination in the Dhaka-11 constituency.
The appeal was filed over allegations of dual citizenship and suppression of information against Dr Kaiyum. Advocate Zahirul Islam Musa, counsel for Nahid Islam, confirmed the development to the media on Saturday.
He said the matter may be placed for hearing before the chamber judge of the Appellate Division on Sunday.
Earlier, on February 3, the High Court summarily rejected the writ petition challenging the legality of Dr Kaiyum’s candidacy. The order was passed by a bench comprising Justice Fahmida Kader and Justice Md Asif Hassan.
During the High Court proceedings, the writ petitioner was represented by lawyers Mohammad Hossain Lipu and Advocate Zahirul Islam Musa, while Dr Kaiyum was represented by Advocate Ahsanul Karim, Barrister Ruhul Quddus Kajol, Advocate Mahbubur Rahman Khan and Barrister Kazi Akhtar Hossain.
The writ petition was originally filed on February 2 by Nahid Islam, seeking suspension of Dr Kaiyum’s candidacy on grounds of alleged dual nationality and failure to disclose information in the nomination papers. The petition named the Chief Election Commissioner and other relevant authorities as respondents.
Prior to the legal challenge, the Election Commission had declared the nomination papers of both Nahid Islam, the 12-party alliance candidate and NCP convenor, and BNP nominee Dr MA Kaiyum, who also serves as the party’s secretary for microcredit affairs, as valid for the Dhaka-11 constituency.
